The course examines the historical, political, and constitutional factors that drive implementation and enforcement of environmental law at the federal and state levels, and how federal and state government roles vary in environmental law regulatory frameworks. It then applies this conceptual foundation to federal environmental law statutes addressing environmental impact assessment, water pollution, air pollution, endangered species protection, and hazardous waste site remediation to analyze and compare the regulatory principles involved ineach context. The course also addresses cutting-edge topics in U.S., foreign domestic, and international environmental law including environmental justice, strategic climate change litigation, constitutional and human rights to environmental protection, and the rights of nature.
